Affiliate Program Terms and Conditions

1. Introduction

By signing up to be an Affiliate in our Affiliate Program, you agree to be bound by the following terms and conditions (“Terms”). Please ensure that you read them carefully before applying.

2. Eligibility

• You must be at least 18 years old to participate in our Affiliate Program.
• Your business, website, podcast, channel, and/or social media pages must not contain any illegal, offensive, or harmful content, including but not limited to hate speech, discriminatory content, or anything that violates intellectual property rights.
• You agree to positively and accurately present Santek Abrasives and our products and services.

3. Application Process

• All applicants must submit accurate and complete information during the application process.
• Once an application has been received, you may be asked to submit additional personal information for our records. This may also be followed by an interview.
• We reserve the right to approve or reject any affiliate application at our sole discretion, without providing any reason.

4. Affiliate Links and Promotion

• Affiliates may use approved links, banners, and other creatives provided by us for promoting our products and services.
• Affiliates must not modify or alter the affiliate links in any way.
• Spamming is strictly prohibited. This includes unsolicited email, posting in newsgroups or forums in a way that is inappropriate or violates their terms, and any other forms of spamming.

5. Commissions and Payment

• Commissions are earned based on the successful sales generated through your affiliate links, as outlined in our commission structure.
• Commissions will only be paid on transactions that are completed, and not on returns or chargebacks.
• Payment thresholds, schedules, and methods will be determined by us and communicated to you. We reserve the right to change the payment structure at any time, with prior notice.

6. Compliance with Laws

·       Affiliates are responsible for complying with all applicable laws, regulations, and guidelines, including but not limited to FTC disclosure requirements, GDPR compliance for data privacy, POPI act and Competition Commission policies.

7. Termination

• Either party may terminate this agreement at any time, with or without cause, by providing written notice to the other party.
• Upon termination, you must immediately remove all affiliate links and cease any promotion of our products or services.

8. Intellectual Property

• All intellectual property rights, including trademarks, logos, and service marks, used in the Affiliate Program are owned by us or our licensors. Affiliates are granted a non-exclusive, non-transferable license to use these materials solely for the purpose of promoting our products and services.

9. Limitation of Liability

• We shall not be liable for any indirect, special, or consequential damages, including but not limited to loss of revenue or profits, arising out of or in connection with this Agreement.

10. Governing Law

• This Agreement shall be governed by and construed in accordance with the laws of South Africa, without regard to its conflict of laws principles.

11. Modification of Terms

• We reserve the right to modify these Terms at any time. Any changes will be communicated to you via email or posted on our website. Continued participation in the Affiliate Program after any such changes shall constitute your consent to such changes.
